Welcome to Hózhó Academy. Please read these Terms of Service ("Terms") carefully as they contain important information regarding your legal rights, remedies, and obligations concerning your use of our website, applications, communications, services, and facilities (collectively, the "Services"). Hózhó Academy is a tuition-free New Mexico Charter School that develops students in mind and character through a classical, content-rich curriculum that emphasizes the principles of virtuous living, traditional learning, and civic responsibility.

EDUCATIONAL SERVICES

Enrollment

Enrollment at Hózhó Academy is subject to:

Completion of all required application materials
Compliance with New Mexico charter school enrollment procedures
Space availability and lottery procedures when applicable
Provision of required student records and documentation

School Policies

All students and families agree to abide by school policies as outlined in the Parent-Student Handbook, including but not limited to:

Educational Materials

Educational materials provided to students remain the property of Hózhó Academy unless explicitly designated as consumable resources. You agree to:

Return non-consumable materials in reasonable condition
Pay replacement costs for lost or significantly damaged materials

School Technology

Use of school-provided technology is governed by our Acceptable Use Policy and is provided to support our educational mission. Students and families using school technology agree to:

Use devices and networks only for educational purposes
Follow all security protocols and not attempt to circumvent protections
Report any technical issues or security concerns promptly
Return all devices in working condition when requested

Electronic Communications

By providing your email address or phone number, you consent to receive communications from Hózhó Academy related to:

Recording and Photography

YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES

Indemnification

You agree to defend, indemnify, and hold harmless Hózhó Academy and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of and access to the Services or your violation of these Terms.

COMPLIANCE WITH LAWS

FERPA Compliance

Hózhó Academy complies with the Family Educational Rights and Privacy Act (FERPA). Parents and eligible students have certain rights regarding student education records as detailed in our Privacy Policy.

Dispute Resolution Process

Any dispute arising from or relating to these Terms or our Services shall be resolved through the following process:

Informal Resolution: We encourage users to contact us directly to attempt to resolve any disputes.
Formal Complaint: If informal resolution is unsuccessful, you may submit a formal written complaint to our administration.
Mediation: If the formal complaint does not resolve the dispute, the parties agree to participate in mediation in McKinley County, New Mexico.
Legal Action: If mediation is unsuccessful, legal proceedings may be commenced in courts located within McKinley County, New Mexico.

TERMINATION

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.

ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hózhó Academy regarding our Services and supersede all prior agreements and understandings, whether written or oral.
